Public Services Reform (Scotland) Bill

The Public Services Reform (Scotland) Bill was introduced to the Scottish Parliament on 28 May 2009. This Bill includes provisions which will allow charities to provide all their trustees with Trustee Indemnity Insurance (TII) paid for from charity funds. This will remove the unintended restrictions placed on its provision by the Charities and Trustee Investment (Scotland) Act 2005, which has been of concern to the charity sector. The regulatory impact assessment on these TII provisions can be viewed here. The Bill also includes the powers by which we hope to make future changes to the Scottish Charity Appeals Panel.

Consultation - the 2005 Act and the Charities Accounts (Scotland) Regulations 2006

We launched a consultation on 27 April 2009 on possible minor amendments to the 2005 Act and the Charities Accounts (Scotland) Regulations 2006. The proposals for minor amendments to the Act are drawn from recommendations made to Scottish Ministers by OSCR in their 2007-2008 Annual Report.

The consultation also includes proposals for amending the detailed accounting requirements which charity have to follow. While most of these are technical or housekeeping in nature, issues such as thresholds and public benefit reporting are also included. The consultation closed on 24 July 2009.

Charities and Benevolent Fundraising Regulations

The Charities and Benevolent Fundraising (Scotland) Regulations 2009 were laid before Parliament on 25 March and come into force on 1 July 2009.

Further and Higher Education Scotland Act

The Further and Higher Education (Scotland) Act 1992 Modification Order 2009 was laid before Parliament on 30 January 2009 and came into force on 9th March 2009.

Charities Assets and the Charity Test

The Protection of Charities Assets (Exemption) and the Charity Test (Specified Bodies) (Scotland) Amendment Order 2008 was laid before Parliament on 12 December 2008 and came into force on 1 January 2009 and 25 January 2009.

Scottish Charity Appeals Panel (SCAP) to be abolished

The Finance Secretary announced , as part of the Scottish Government's review of scrutiny bodies, that the Scottish Charity Appeals Panel (SCAP) would be abolished as a stand alone body, but an appeals route for charities would be maintained. A consultation paper on future options will be published shortly. In the meantime SCAP will remain until a suitable recipient has been found for its work.
