Status: Tribunal NDPB
Established: 1971, under the Lands Tribunal Act 1949. The Tribunal was originally set up in Scotland to deal with the discharge or variation of land obligations under Section 1 of the Conveyancing and Feudal Reform (Scotland) Act 1970, but its jurisdiction has subsequently been extended. From 28 Nov 2004 the Abolition of Feudal Tenure etc. (Scotland) Act 2000 will confer a new jurisdiction on the Tribunal as will the Title Conditions (Scotland) Act 2003. The latter repeals Section 1 of the 1970 Act, effectively replacing it as authority for the discharge or variation of title conditions.
Terms of Reference: The Tribunal deals with disputed valuations of land; the discharge of restrictive title conditions; disputes during council house purchase under tenants' rights legislation; appeals against the Keeper of the Registers of Scotland and voluntary or joint references of consent.
