Where did the idea of a Property Questionnaire come from?

The concept of a property questionnaire was proposed by a representative of the Law Society as an alternative to a document-based pack of information. The Property Questionnaire will provide house buyers with useful additional information about the home they are considering buying. Many solicitors and estate agents currently use their own form of the questionnaire for gathering information about the house that they will be marketing, albeit they do not currently make the information available to prospective purchasers.

What information does the Property Questionnaire contain?

The questionnaire will contain information that relates directly to the property including the council tax banding, parking arrangements, factoring arrangements and whether there have there been any alterations carried out to the property.

Who will complete the Property Questionnaire?

The questionnaire will be completed by the seller of the property and will be provided upon request to the purchaser.

What recourse will the purchaser have against the seller if the seller has made a false statement in the questionnaire?

It is likely that the questionnaire will be referred to in the missives. The Property Questionnaire could therefore be relied on by the purchaser.

What feedback has there been on the Property Questionnaire?

The questionnaire was tested on a small scale during the winter of 2006/07 in the Scottish housing market. It is largely based on existing good practice models. Both the Law Society of Scotland and the National Association of Estate Agents are strongly in favour of its introduction as a means of promoting good practice amongst selling agents and as a positive influence on the conveyancing process.
