Principles

All decisions made on behalf of someone who is unable to make some or all decisions for themselves must:

  • Benefit the person.
  • Take account of the person's past and present views and wishes - and provide every assistance necessary to aid understanding and communication.
  • Take account of the views of the nearest relative, primary carer, guardian or attorney and others with an interest in the person, as far as possible.
  • Restrict the person's freedom as little as possible to achieve the desired benefit.
  • Encourage the person to use their existing skills and develop new skills.
